I suggest you to take a look at Bowers v. Hardwick, it
deals with a GA sodomy law.
The author of the following argument should frame
her(his) arguments following the ruling in Hardwick.
She should first try to get the court to follow
precedent (stare decisis doctrine) in Hardwick,
because as of today, Hardwick ruling is the current
law.
Then she should get the court not only to following
its own ruling, but also give the legislature of TX
deference when it comes to the interpretation of a
particular law.
*Becareful as to the point telling the Court what the
proper role of the Court. It's true the the Court is
there to interpretate the law, and not making the law.
However, everyone knows that the Court's making of
the law is reflected in its rulings, (the whole
concept of Judicial Review)
