Mayor’s aides address concerns of immigrants about new order

City officials say Executive Order 34 not to report immigrant status to BCIS



New York City Mayor Michael R. Bloomberg and officials of the Immigrant Affairs, Health, Legal and Domestic Violence departments assured the immigrant communities that the Executive Order 34 issued by the mayor last week was to “help them take advantage of city services and reiterated that the officials will not act as an arm of the federal immigration bureau with regard to immigration status.”



The order, issued by Michael Bloomberg recently, revoked a prior policy of confidentiality of immigration status information, which was issued by Mayor Ed Koch in 1989. Various immigrant and civil rights groups had protested the order, saying that it would facilitate the city officials to report immigrants to the Bureau of Citizenship and Immigration Services (BCIS) if they sought city services.



Reacting to these apprehensions, Carol Robles-Roman, Deputy Mayor, Legal Affairs; Sayu Bhojwani, Commissioner, Mayor’s Office of Immigrant Affairs; Yolanda Jimenez, Commissioner, Mayor’s Office of Domestic Violence; Dr. Benjamin K. Chu, President, Health and Hospital Corporation; and John Feinblatt, Mayor’s Criminal Justice Coordinator told a press conference of immigrant newspapers and publications hosted by the Independent Press Association (IPA) on June 6 that there was only one intention in issuing the order, which was to reiterate New York City’s policy of administering services to immigrants.



“We have a ‘don’t ask policy. You do not have to reveal your immigration status to send your kids to school, get medical treatment or report a crime. Only with regard to Medicaid, Food Stamps and Social Security Insurance do we need to ask the status as only legal immigrants can avail of these services. If a certain immigrant’s status is not legal, then we would deny the service. But the person will not be reported to any federal authority. Our aim in asking for status is to provide the services. The Mayor has made it clear that no city agency will become an arm of the BCIS. In fact, as far as we know, there has not been a single instance of an NYC official reporting an immigration violation to federal authorities,” said Carol Robles-Roman. Bhojwani said “Mayor Koch had issued Executive Order 124 in 1989 which forbade city officials to disclose to the federal government the immigration status of people they come into contact with. However, a federal law invalidated this order in 1996. So we had to issue the new order but at the same time make it clear to immigrants that they should not hesitate to avail of city’s services,” she said.



Bhojwani said the mayor has issued a special message to the immigrant communities (which was circulated at the press conference) which reiterated that there is no obligation for the city to report the status to the federal government. Bhojwani said a new 311 service for non-emergency services has been launched recently and that queries would be responded in 170 languages. “Immigrants, specially those who do not know English, who have any questions regarding Executive Order 34, can call this service and obtain clarifications.”



The mayor’s message said: “It is in the public’s interest and important to everyone’s health, safety, and welfare that all immigrants, like all the other residents of the city, take advantage of important city services.” Bloomberg said the federal law made Mayor Koch’s order illegal. “So we have modified the order so that city officials won’t ask your immigration status, unless we have to.... The police might need to ask about immigration status if they are conducting a criminal investigation. The order makes clear that when the police are investigating a crime, they can ask the criminals about anything, including whether they are in the United States legally. Mayor Koch’s order had the same exception for criminal investigations.



“We want to be sure that undocumented immigrants get vaccinated against contagious diseases and report crimes or domestic abuse. We have no interest in becoming an arm of the BCIS, formerly INS….



Dr. Chu said he would be issuing a memo to all the staff in the next couple of days instructing them on the new order. “They will need to ask only in case of Medicaid. We want to reassure the immigrant communities that they have nothing to fear and that the city services was for them to avail of,” he said.



Feinblatt said the police will not ask victims and witnesses their immigration status. “We want people to come forward and report anything wrong. There is no worry for the law-abiding citizen. However, if you indulge in criminal activities, and if the police has reasonable suspicion that you are engaged in any criminal activity, your status can be questioned,” he said.



Yolanda Jimenez said on an average, 600 calls of domestic violence is received by the police everyday. “40 percent of immigrant women are subject to domestic abuse, as against the 25 percent average for the general population. We want victims to come forward and report such abuses. No questions will be asked. Whether you are undocumented or on a dependent status, and if you are being abused by your husband or partner, we would like to help you, also in applying for a U-Visa (granted to women victims of domestic violence) with the federal authorities.



Last year, there were 78 domestic violence homicides, and 68 percent of these cases, the victims had never complained to the police before. We want the immigrant women victims of abuse to come forward and seek help,” she said.
